Yip, but the government like tae make a noise about things, so they get our votes then turn on what they said.....

I think the government are just puppets, with more sinister, dangerous people behind them with the real power and say....

The Zero-rating of the train transport only at Cairngorm is a bit of a fudge but as things stand, there is little chance of widening the zero-rating any further by amending legislation.
Both our Government and Brussels are actively trying to prevent all extensions to the UK's slightly embarassing Zero rate. Pretty much every other country has a low rate, not zero. And our zero is applied to all sorts of things like childrens' clothing that are taxed elsewhere.
I seem to remember hearing a while ago that the Vat Tribunals had heard the Cairngorm case and that's why we have the current situation as it is.

We could use a Nevis insider telling us why they were unable to follow through on the Cairngorm decision.

Back on William's point, you would think it'd be cheaper to promote sport than to fix fat and unhealthy people later in their lives.

The Funicular fell under HMRI (Her Majesty's Railways Inspectorate) Remit so they could hardly deny it was a railway.

The Nevis Gondola only has 6person cabins - if it was a 12seater gondola there would be no case to answer, it would automatically be vat exempt. The point of arguement is that the gondola with a single drive is a single complete transport system rather than the individual carriers.

Does anyone know, did Nevis Range Developments try taking this specific issue to the Vat Tribunal themselves after the partial success of the Cairngorm decision?
The Vat appeals are a public hearing system, open to visitors and publishing its findings.
At the end of the day it has to be a business decision by the company as to whether they think it would be worth the effort and expense to pursue and such hearings are always something of a gamble by both sides.

The only time that certainty arises is after exhausting the whole appeal circus: Tribunal, Court of Session, House of Lords and finally European Court of Justice.
And it would be hard to argue on the basis that the rest of Europe uses a low rate of Vat for uplift transport until you arrived in the ECJ. Ouch.

And what exactly do the French/Spanish/Italians/Austrians do...
It cannot be 'exempt', transport has to be taxed under the EU directives, usually at a low rate. Our "low" rate is zero in the UK. Any EU Vat experts out there?

Is it possible that other EU countries treat the lift pass as providing a sport rather than transport or a combination of both? Are sporting services exempt or zero rated in the EU, a quick search on google would suggest that sporting services may be exempt but it's hard to determine this.

VAT is such a nightmare - just look at what McVities had to do to prove a Jaffa Cake really is a cake!
