The Funicular fell under HMRI (Her Majesty's Railways Inspectorate) Remit so they could hardly deny it was a railway.
The Nevis Gondola only has 6person cabins - if it was a 12seater gondola there would be no case to answer, it would automatically be vat exempt. The point of arguement is that the gondola with a single drive is a single complete transport system rather than the individual carriers.
